Before recruiting a foreign worker, a Canadian employer must get an LMIA, or Labor Market Impact Assessment. It demonstrates that a foreign worker is required to fill a position and that no Canadian or permanent resident is available.


How to get an LMIA?

If an LMIA is needed for a Canadian Business, it must meet the following criteria:

  • There is a requirement for a foreign worker on a temporary basis.
  • There are no Canadians or permanent residents available for the position.

One of these applications must be used to apply for an LMIA

  • High-Wage worker application
  • Low-wage worker application
  • Seasonal Agricultural Worker Program
  • Agricultural Stream


What to do after receiving your LMIA?

The Temporary Foreign Worker Program (TFWP) lets you hire temporary foreign workers to fill skill shortages and labor. Once an LMIA has been obtained, you should provide each temporary foreign worker a copy of the confirmation letter and instruct them to apply for a work visa. An LMIA from ESDC, Service Canada, is required.

When it comes to your LMIA application, don’t take any chances. It’s a difficult process, and rejection takes time and money.
